Punitive Damage Claim Against Major Trucking Company

On May
9, 2008, a Maricopa County Superior Court jury unanimously
rejected a punitive damage claim against one of North
America's largest trucking companies and one of its drivers.

the defense team that secured the favorable verdict.
The
plaintiffs in this case had sought punitive damages in the
range of $26-80 million, based on the company's claimed market
value of more than $2.6 billion. Rather than being influenced
by the high valuation of the trucking company, the jury agreed
with the defense position that the driver was not speeding and
simply over-corrected while trying to avoid hitting a car that
had drifted into his lane.
The
verdict concluded the retrial of a wrongful death lawsuit that
had been remanded by the Arizona Court of Appeals.
