Litigation and Dispute Resolution

Immediate Attention. When a client brings a case to us, we determine what action, if any, we need to take immediately to preserve the client's rights or minimize the exposure. We deploy "immediate response teams" to obtain, secure, and analyze evidence ranging from skid marks to witness accounts, that might disappear or degrade over time. Prompt action also creates work-product protection at an early stage of the dispute.

Preliminary Evaluation. In every case, our preliminary evaluation includes identifying important facts, developing legal theories, and analyzing the client's potential exposure. Next, we work with the client and any insurer to develop a dispute resolution strategy and a budget for carrying out that strategy. In those cases where liability is clear and the potential exposure is significant, this early evaluation can lead to a prompt and advantageous settlement before the matter escalates.

Application of Expertise. Our firm is large and diverse enough that we possess expertise in nearly every aspect of legal practice. For example, in dispute resolution, we do not dabble - it is part of the everyday work of most of our lawyers. Legal research is the lifeblood of any sophisticated practice, so our lawyers know the current case law and stay up to date as the law develops over time. Many of our cases require the assistance of expert witnesses and consultants - we work with nationally-recognized authorities to provide our clients with the best information and the most effective testimony. We use these and many other skills to obtain the best results in a cost-effective manner.

Balanced Viewpoint. Despite our trial experience and success, we understand that a trial is not in every client's best interests. We offer advice not only on the legal status of a case, but also on the economic and public relations effects of litigation. While the client always holds the decision how to proceed, we believe that part of our service as advisors and counselors is frank assessment of approaches and potential outcomes.

Skilled Advocacy. When a case does go to trial, we are in our element. Our lawyers have a record of success in hundreds of jury trials and arbitrations. We know how to frame an argument and present complex evidence so jurors can understand the facts and relate to our client's position.
